Hasipoğlu: Observing the Potential Transition of the Isias Case to Possible Intent

Oğuzhan Hasipoğlu, UBP General Secretary and the Chairman of the Temporary and Special Committee Established to Monitor the Legal and Judicial Process Regarding the Earthquake in the Republic of Turkey, commented on the interim decision in the Isias Hotel case. Hasipoğlu stated, "We clearly observe from the expert testimonies we heard during the hearing on April 26th that the incident should be considered as a case of possible intent."

Referring to their support for the pursuit of justice from the first day, both with the government and the opposition, Hasipoğlu emphasized that justice will prevail sooner or later.

Having followed the Isias case with committee members in Adıyaman, Hasipoğlu evaluated the interim decision.

Expressing their astonishment at the fact that while all expert and witness testimonies in court clearly indicate the primary fault of the hotel's collapse, the Bozkurt family can still say, "Our hotel was solid, we did not make a mistake," Hasipoğlu stated that the claims of those who do not come to court with clean hands will not be taken into account.

Hasipoğlu noted that the court patiently gives everyone a voice, stating, "From the expert testimonies we heard during the hearing on April 26th, we clearly see that the incident should be considered as a case of possible intent."

Hasipoğlu said that it was revealed from the testimonies that a construction permit was obtained with a handwritten note and stated, "We understand that there are actions and negligences that suggest murder."

Hasipoğlu emphasized that the defendants should be tried for possible intent. Committee Chairman Oğuzhan Hasipoğlu stated, "By reading the interim decision, the court has adjourned the trial until Wednesday, June 12, 2024. The pre-trial detention of the detained defendants Ahmet Bozkurt, Mehmet Fatih Bozkurt, and Erdem Yıldız has been ordered to continue. Considering the discussions and criticisms on the expert report from Gazi University, which forms the main axis of the trial, the court has decided to appoint a new university to prepare a new expert report on the file."

Highlighting the vital importance of the expert report as evidence, Hasipoğlu added, "Referring the matter back to the expert is a significant development."

Hasipoğlu continued his remarks as follows:

"We knew that the Gazi report did not satisfy us. Therefore, under the chairmanship of Prime Minister Mr. Ünal Üstel, our Parliamentary Committee held meetings with the leaders of the Main Opposition, as well as some members, in Ankara and Cyprus. With the consultation of the lawyers, expert reports were prepared to identify the deficiencies and/or errors in the Gazi report. Despite the objections of the defense lawyers, the Adıyaman Court heard the expert witnesses who came to the court, expressing that it would give the same right to the defendants. Ultimately, as requested, the Court, not finding the Gazi report sufficient, decided to appoint a new expert committee. We do not want any aspect to remain ambiguous. Therefore, we consider the court's decision to request a new expert report for the fourth time from İTÜ, Karadeniz Technical, and Gazi Universities as a positive development. The deep wounds of the disaster that broke our hearts are still piercing us. We will continue to do our best to heal the wounds of this century's disaster, which claimed the lives of more than 50,000 people in Turkey and included our Champion Angels in our country, and to keep the names of our citizens alive."
