Minimum Wage Lawsuit Concludes: No Injunction, Real Data Use Mandated
In the case filed by Hür-İş challenging the latest minimum wage, the court did not issue an injunction, but mandated the use of real data in wage-setting processes.
The Free Workers’ Trade Unions Federation (Hür-İş) had argued that the minimum wage set at the beginning of 2024 was below the cost-of-living index and thus unlawful. While the court refrained from suspending the current wage, Hür-İş welcomed the ruling.
Speaking on Kanal T, Hür-İş President Ahmet Serdaroğlu emphasized that although the court did not grant an interim order, the decision imposes significant obligations on the Minimum Wage Determination Commission.
“We achieved the result we wanted,” said Serdaroğlu. “If the court had issued an injunction, the previous wages would have been reinstated. Instead, the court made it clear that from now on, the commission must base wage decisions on real data and economic indicators. Meeting minutes must reflect actual figures.”
Background
On January 17, the Minimum Wage Commission approved a new gross wage of 43,469 TL (net 37,818 TL) by majority vote, prompting the workers’ representatives to walk out in protest. Hür-İş subsequently took the matter to the High Administrative Court, citing a 7.5% increase that fell short of inflation.
The ruling is seen as a potential precedent for ensuring transparency and judicial oversight in future wage decisions.
