BTHK: Use of Starlink and Similar Satellite Communication Devices Is Illegal and Prohibited

The Information Technologies and Communication Authority (BTHK) announced that Starlink and similar satellite communication terminals cannot be imported or used in the TRNC until proper authorization is granted, and that their use constitutes a violation of the law.

The authority warned that anyone knowingly using these services or assisting in their operation would be committing a crime, subject to a fine of up to four times the minimum wage, imprisonment of up to six months, or both.

BTHK stated: “Until authorization for satellite communication services is granted by the Authority, devices providing communication via satellite, such as Starlink, will not be allowed to undergo import pre-approval procedures, except in exceptional cases required for public safety.”

According to the announcement, under the Electronic Communications Law No. 6/2012, the provision of electronic communication services, the establishment and operation of electronic communication infrastructure and networks, and the import, sale, and use of devices in these services fall under the authority and supervision of BTHK.

Similarly, under the Product Safety Law (42/2014) and its related Terminal Equipment Regulations, all terminal equipment must undergo a “Pre-Approval Compliance Assessment” before entering the country.

BTHK Review Regarding Starlink Devices

The Starlink system, developed by SpaceX, consists of small terminals providing internet access directly via low-earth orbit (LEO) satellites without relying on local infrastructure.

While the devices carry CE markings and use frequencies compatible with the national frequency plan, BTHK determined that, under Section 5 of the Electronic Communications Law, such electronic communication services require authorization.

“Unauthorized Use Is Illegal”

The Authority emphasized that the establishment, operation, and use of unauthorized electronic communication services are prohibited. It stated: “Anyone knowingly using these services or assisting in their operation will be considered to have committed a crime. Under Article 102(12) of the Law, these actions may be punished with a fine of up to four times the minimum wage, imprisonment of up to six months, or both.”

BTHK also highlighted that unauthorized satellite communication devices pose serious security risks under the Cybercrime Law, as they may bypass the Authority’s control and monitoring mechanisms, including traffic data.

Following scientific, technical, and legal assessments, BTHK’s Board of Directors decided on October 11, 2024 (Decision No. 2024–K/BTHK–40.115) that Starlink and similar satellite communication devices cannot be imported or granted pre-approval for import until the Authority issues authorization for satellite communication services, except in cases required for public safety.

Therefore, importing or using Starlink devices in the country is illegal until proper authorization is provided.

BTHK reminded the public that unauthorized use of Starlink and similar satellite communication terminals is prohibited, and importation is impossible until authorized by the Authority.

The Information Technologies and Communication Authority reiterated that it will continue all necessary public awareness and monitoring activities to ensure safe, controllable, and legally compliant electronic communication services in the TRNC.
